GENERAL CONDITIONS OF SALE

1. **Introduction**

IssTravel di Aemmes71 srl, with registered office in Rosignano Marittimo (Italy), Località Bargingo 28, VAT no. 02948700923, hereinafter referred to as “IssTravel” is a TOUR OPERATOR with authorization from the Region of Tuscany which, through its multi-channel booking system, operating by telephone, via internet through [www.isstravel.eu](https://isstravel.eu/), or and/or agencies, in Italy or abroad, allows private users (hereinafter “Clients” or singularly “Client”) to book stays for tourist purposes in accommodation facilities such as Hotels, Villages, Resorts, Bed&Breakfast, Villas and Apartments, Residences, Farmhouses, etc… (hereinafter “Accommodation Facilities” or singularly “Accommodation Facility”) together with the use of the services associated therewith.
This Contract for Clients (hereinafter also the “Contract”) consists of the following general conditions (“General Conditions”) and the booking form for the holiday available on the website [www.isstravel.eu](https://isstravel.eu/) or through the telephone booking service. 


**2. Purpose, validity, termination of the contract and legal framework**


2.1 This Agreement governs the terms and conditions of purchase by the Customer of stays for tourist purposes and services offered in the Accommodation.
2.2 This Agreement comes into force when the Customer receives confirmation from IssTravel of the Online Booking or Telephone Booking pursuant to article 3, letters a) and b) below.
2.3 This Agreement complies with Italian and EU consumer protection legislation (in particular, the Consumer Code, Legislative Decree 206/2005 and subsequent amendments and supplements) and tourism legislation (in particular, the Tourism Code, Legislative Decree 79/2011 and subsequent amendments and supplements) and is designed to give optimal protection to the interests and needs of the Customer. 


**3. Operational arrangements**


Prima di procedere all’acquisto di una vacanza, il Cliente prende visione dei posti disponibili nella Struttura Ricettiva e del prezzo stabilito per notte. Il prezzo è espresso in Euro ed è determinato sulla base della tariffa disponibile al momento della prenotazione, a seguito della quale, quest’ultimo verrà bloccato. In ogni caso IssTravel non sarà ritenuta responsabile di eventuali variazioni del prezzo applicate dalla Struttura Ricettiva o a seguito di ulteriori servizi richiesti al momento. Eventuali offerte speciali e promozioni sono esclusivamente limitate al periodo di tempo indicato nella pagina dedicata all’offerta di prenotazione. IssTravel offre la possibilità ai suoi Clienti di acquistare soggiorni turistici con i servizi eventualmente connessi secondo le modalità e le condizioni di seguito elencate: a) Prenotazione On LineIl Cliente potrà scegliere il soggiorno turistico tra quelli offerti da IssTravel, prenotandolo direttamente dal sito internet [www.IssTravel.eu](https://isstravel.eu/) attraverso la Prenotazione On Line. All’atto della Prenotazione On Line il Cliente sarà tenuto a indicare nell’apposita sezione i dati necessari per completare la Prenotazione stessa (nome, cognome, indirizzo città, numero di telefono, email, carta di credito, Struttura Ricettiva prescelta, numero di camere, numero di persone, ecc…). A seguito dell’invio dei dati, IssTravel procederà alla verifica delle relative disponibilità e/o della copertura finanziaria del sistema di pagamento fornito dal Cliente e si riserva di confermare all’indirizzo mail fornito da quest’ultimo, il perfezionamento della stessa. Il Cliente è tenuto a verificare i dati contenuti all’interno della email di conferma di IssTravel, comunicando senza ritardo, via email all’indirizzo [booking@isstravel.eu](mailto:booking@isstravel.eu) o all’indirizzo email di conferma, eventuali errori od omissioni rispetto alla Prenotazione On Line. Qualora l’email di conferma inviata da IssTravel contenga errori e/od omissioni rispetto alla Prenotazione On Line e il Cliente non lo rilevi tempestivamente, l’offerta si riterrà accettata così come indicato nella email di cui sopra, e il Cliente sarà comunque tenuto alla corresponsione del prezzo per la relativa Prenotazione On Line, esonerando espressamente IssTravel da qualsiasi responsabilità. La Prenotazione On Line non potrà ritenersi in ogni caso perfezionata nell’ipotesi in cui il Cliente non riceva una email di conferma proveniente da IssTravel.b) Prenotazione telefonicaIl Cliente potrà effettuare una prenotazione anche attraverso il numero di call center pubblicato nel Sito. All’atto della Prenotazione Telefonica, l’operatore di IssTravel rivolgerà al Cliente alcune domande necessarie per completare la Prenotazione Telefonica presso la Struttura Ricettiva prescelta. La telefonata potrà essere registrata solo dopo il consenso del Cliente in conformità alla privacy policy pubblicata nel sito [www.IssTravel.eu](https://isstravel.eu/). In particolare il Cliente dovrà comunicare i dati necessari per completare detta Prenotazione (nome, cognome, indirizzo, città, numero di telefono, email, carta di credito, Struttura Ricettiva prescelta, numero di camere, numero di persone, ecc…). A seguito della comunicazione di tali dati, IssTravel procederà alla verifica delle relative disponibilità e/o della copertura finanziaria del sistema di pagamento fornito dal Cliente e si riserva di confermare all’indirizzo email fornito da quest’ultimo, il perfezionamento della Prenotazione Telefonica. Il Cliente è tenuto a verificare i dati contenuti all’interno della email di conferma di IssTravel, comunicando senza ritardo via email all’indirizzo [booking@isstravel.eu](mailto:booking@isstravel.eu) o all’indirizzo email di conferma, eventuali errori od omissioni rispetto alla Prenotazione Telefonica. Qualora l’email di conferma inviata da IssTravel contenga errori e/od omissioni rispetto alla Prenotazione Telefonica e il Cliente non lo rilevi tempestivamente, l’offerta si riterrà accettata così come indicato nella email di cui sopra, e il Cliente sarà comunque tenuto alla corresponsione del prezzo per la relativa Prenotazione Telefonica, esonerando espressamente IssTravel da qualsiasi responsabilità. La Prenotazione Telefonica non potrà ritenersi in ogni caso perfezionata nell’ipotesi in cui il Cliente non riceva una email di conferma proveniente da IssTravel. Il costo della telefonata potrà variare in relazione all’operatore telefonico utilizzato. 
c) Dati personaliIl Cliente, all’atto della Prenotazione On Line e della Prenotazione Telefonica di cui alle lettere a) e b) sopra, è invitato a non comunicare in alcun modo a IssTravel dati sensibili e/o dati giudiziari ai sensi dell’art. 4, comma 1, lettere d) ed e), del D.lgs. 196/2003. Tali dati non potranno essere trattati da IssTravel e in caso di loro comunicazione, IssTravel non potrà procedere con la vendita dei suoi servizi. 
d) VoucherCon l’invio dell’email di avvenuta conferma della prenotazione ai sensi delle precedenti lettere a) e b) sopra, IssTravel invierà al Cliente un Voucher contenente l’indicazione del pernottamento, della Struttura Ricettiva prescelta e dei servizi connessi acquistati.Il Cliente si impegna a presentare nel momento del check-in presso la Struttura Ricettiva copia del Voucher che IssTravel avrà provveduto ad inviare all’atto della conferma della Prenotazione. I Voucher riporteranno il codice di prenotazione, il nominativo dei clienti, i dettagli della Prenotazione ed eventuali informazioni aggiuntive. 
e) Richiesta di modifica della prenotazione da parte del ClienteNell’ipotesi in cui il Cliente chieda la modifica di una prenotazione già effettuata e confermata, IssTravel non è in alcun caso vincolata alla modifica così come richiesta e, pertanto, nell’ipotesi in cui non riuscisse a far ottenere quanto richiesto dal Cliente, non può essere ad alcun titolo responsabile. Il Cliente sarà comunque vincolato al pagamento del prezzo stabilito e accettato nella prenotazione ovvero al pagamento di una penale come disciplinato all’art. 6 delle condizioni generali di Contratto. Nell’ipotesi in cui IssTravel modifichi su richiesta del Cliente una Prenotazione già effettuata, il Cliente accetta eventuali costi aggiuntivi i quali graveranno esclusivamente sullo stesso. 


**4. Responsibilities of IssTravel**


4.1 IssTravel declares that this programme is covered by an insurance guarantee, with all the extensions required by the Regional Law n.14/2018 of 09/05/2018 of the Region of Tuscany to cover the aforementioned C.C.V. of Brussels of 23/4/1970. Extremes of the insurance guarantee: R.C. policy of Europ Assistance Italia S.p.A., policy no. 4435628. IssTravel is liable for damages caused to the customer due to total or partial non-fulfilment of the services contractually due, whether these are carried out by him personally or by third party service providers, unless it is proven that the failure is due to the customer (including initiatives taken independently by the latter during the course of the trip or stay) or by facts unrelated to the provision of services under the contract, by accident, force majeure, or circumstances that the organiser could not, according to his professional diligence, reasonably foresee and resolve4.2 CANCELLATION INSURANCE POLICYBecause they are not expressly included in the price, at the time of booking it is possible, indeed advisable, to take out a special insurance policy against the costs arising from the cancellation of the package.
4.3. GUARANTEE FUND In compliance with the legal obligations arising from D.LGS21 May 2018 n.62 – art. 47 of the Tourism Code – D. lgs 23.5.2011, n. 79 the undersigned Travel Agency has adequate contract.
4.4 In the event that the Accommodation does not fulfil (for example, does not offer the booked place or the services purchased for the trip or stay) or partially fulfils by providing an unsuitable service, not in accordance with the Online Reservation or the Telephone Reservation or lacking in all or some of the services, IssTravel shall not be in any way responsible, nor called upon to respond to any legal action for compensation for damages. The Customer therefore exonerates IssTravel from any responsibility for the contractual default of the Accommodation. IssTravel shall also not be liable directly or indirectly for any form of liability to obtain compensation for damages for cancellations, changes to travel services, even if due to force majeure. Such events include, but are not limited to: wars, terrorist activity, attacks, national and international strikes, fires, epidemics, climatic events of particular magnitude, environmental disasters or other events that may discourage the departure and / or stay even in the absence of official communications from institutional bodies referring to the places object of the Reservation.
4.5 IssTravel shall not be liable for any fraudulent or negligent acts that may occur during the stay or the travel period, or within the accommodation facility, on the premises of the same or following the use of services offered by the same.
4.6 The Customer is also responsible for the correctness of the data communicated during the Online Booking or the Telephone Booking, for errors and/or omissions and expressly exempts IssTravel from any liability in the event that the Reservation is not confirmed or differs from the proposed one as a result of such incorrect information. 


**5. Overbooking**


IssTravel disclaims any liability in case of overbooking (excess of bookings over the number of available seats) attributable to the Accommodation Facility. IssTravel shall not be liable in any case in case of overbooking due to difficulties or organizational problems related to the Caravan and, therefore, not controllable, nor verifiable, and beyond any responsibility of IssTravel. Notwithstanding the above, IssTravel, in cases of overbooking, will try, as far as possible, to find alternative solutions in favour of the Customer and in collaboration with the Accommodation. 


**6. Right of withdrawal, cancellation and penalties**


6.1 The Client is aware that the right of withdrawal of the consumer is not foreseen for distance contracts pursuant to Legislative Decree 206/2005 and subsequent amendments (Consumer Code) as it is not applicable to leisure services where the contract foresees a specific date or period of performance as in the case of Telephone Reservations or Online Reservations. up to 30 days prior to arrival: no penalty; – from 30 to 21 days prior to arrival: 10%; – from 20 to 15 days prior to arrival: 30%; – from 14 to 8 days prior to arrival: 50%; – from 7 to 3 days prior to arrival: 50%; – from 2 to 0 days prior to arrival: 100%.These penalties may be subject to variation in relation to the chosen Beauty Farm, as communicated in the confirmation email of the online or telephone reservation. To cancel a reservation, the Client must send an email to [booking@isstravel.eu](mailto:booking@isstravel.eu), indicating the reservation number and the name of the person who made the reservation. In case of cancellation, bank and administrative fees will be charged.


**7. Complaints**

7.1 The Customer who intends to dispute the execution of the Contract must promptly contact IssTravel so that the Beauty Farm, or IssTravel on behalf of the Beauty Farm and as far as possible, can remedy the situation.
7.2 The Customer under penalty of forfeiture shall communicate the complaint by sending an email to [booking@isstravel.eu](mailto:booking@isstravel.eu) or by pec to [aemmes71srls@pec.it](mailto:aemmes71srls@pec.it) no later than ten working days from the date of check-out from the Beauty Farm, with proof of receipt of the email by IssTravel. IssTravel shall in any case guarantee a prompt response to the consumer’s requests.


**8. Methods of payment and invoicing**

The Client of IssTravel must proceed with the full payment of the price of the reservation made directly to IssTravel, which will issue to him a regular receipt/invoice of payment. At the time of booking and confirmation by IssTravel shall be paid a deposit of 25% of the participation fee, in addition to the registration fee if applicable. The balance must be paid to IssTravel 21 days prior to departure. For bookings made within 21 days of departure the balance is required. Failure to make the above payments on the agreed dates constitutes an express termination clause of the contract, such as to determine the cancellation, subject to any compensation for damages suffered by IssTravel and the Seller Travel Agency as a result of the forced cancellation of the contract.

**9. Privacy**

The reservation at an Accommodation Facility will require the communication by the Customer to IssTravel of a series of information (e.g. e-mail address, landline or mobile phone number, VAT number or tax code, citizenship, residence, etc.) and in any case aimed at allowing a correct management of the reservation in accordance with the relevant applicable regulations (hereinafter “Customer Personal Data”), subject to the provisions of art. 3, letter c) of this Contract. Pursuant to D. Lgs. n. 196/2003 and subsequent amendments and additions, IssTravel is the exclusive owner of the processing of Customer Personal Data in accordance with the Privacy Policy of IssTravel available on the website [www.isstravel.eu](https://isstravel.eu/).


**10. IssTravel Proprietary Rights**

**IssTravel** is the creator and author under the Law April 22, 1941, n. 633 and subsequent amendments and additions of the technological platform of the site [www.IssTravel.eu](https://isstravel.eu/) and the brand and logo “IssTravel” whether registered, unregistered or pending registration in any country in the world, and it is reserved all related rights including rights of economic exploitation. The property of IssTravel is the website [www.IssTravel.eu](https://isstravel.eu/), any mobile applications under the name “IssTravel”, the related operating platform, related software and computer architecture, all databases relating to all Customers of the website [www.IssTravel.eu](https://isstravel.eu/), the codes, methods, algorithms, instructions representative of improvements of a technical, creative or organizational nature, updates, releases and any and all applications and functionalities connected to the aforementioned websites and applications, results or findings, are used or developed by IssTravel – or by third parties appointed by IssTravel – for the coordination and interaction of said websites and applications for mobile devices or for the creation, activation, online management and/or for the provision of services to Customers. In particular IssTravel has full ownership of the software, know-how, programs (application and operating) for computers, codes, related adaptations, modifications and customizations of the indications, instructions and documents, in any form expressed, installed or to be installed, including those related to and/or developed in connection with the above mentioned website and mobile applications and related business models.


**11. Obligations of compensation**

If the Customer causes in any way, damage to the Accommodation, IssTravel shall not be held liable and the Customer indemnifies IssTravel from any relevant liability, cost, expense, damage, assuming the relevant responsibility. 


**12. Amendments to the General Conditions**

The present General Terms and Conditions may be unilaterally modified by IssTravel which shall promptly notify the same by publication on the Site. 


**13. Place of jurisdiction**

The present Contract shall be governed by Italian law. All disputes arising out of this Contract, including those relating to its validity, interpretation, execution and termination, shall first be submitted to an attempt at amicable settlement between the parties by sending a conciliatory proposal from the party concerned to the other. The conciliation shall be inspired by the absence of formalities. If the attempt at conciliation fails within a period of 60 days from the date of sending the conciliatory proposal, the disputes shall be referred to the exclusive jurisdiction of the Court of Livorno (Italy).
